The Claik – Terms and Conditions
We have put together these Terms and Conditions to make sure you understand what is involved once you have become a member of The Claik, the University of St Andrews’ online insights community.
Membership Conditions
The Claik Membership
To become a member of The Claik, you must meet the definition of one of the following categories:
A registered student at the University of St Andrews
A confirmed alumnus of the University of St Andrews
A confirmed member of staff at the University of St Andrews
You must complete and submit the registration survey by clicking on Sign up on the insights.st-andrews.ac.uk website homepage.
By registering to join The Claik you confirm that you have read and accept the following Terms and Conditions. The University of St Andrews reserves the right to modify these Terms and Conditions at any time, and the most up-to-date version can be viewed at any time on the insights.st-andrews.ac.uk website.
Membership of The Claik is non-transferable. Password(s) and any other credentials used to identify a member are classed as confidential information and must not be shared with or passed on to any third party under any circumstances.
Members are responsible for all activities associated with their The Claik account/login. If you suspect or find that there has been a breach of any kind of your The Claik credentials, you must report this to the University of St Andrews at the earliest opportunity.
Confidentiality
The Claik is a University of St Andrews service and is hosted by QuMind Limited (trading as Largo), an independent online market research provider based in London, UK. Please visit www.qumind.co.uk for more information about Largo.
The University of St Andrews and Largo ensure that the personal details you provide on the registration survey (including your name, email address, and other personal details) are held in a secure database with limited access rights.
Any information you provide, either on the registration survey or in subsequent surveys, will be treated as confidential and used as set out in the Privacy Notice.
Data Protection
We aim to be transparent and clear at all times and to keep your information safe. Please see our Privacy Notice at insights.st-andrews.ac.uk for more information about how your personal data will be used.
By using The Claik, you warrant that all data provided by you is accurate and up-to-date.
Cookies
Cookies are used for validation and to prevent repeat surveying. Please see Largo's Cookie Policy for full details. You can configure your browser to notify you when cookies are being placed on your computer. You can also delete cookies by adjusting your browser settings.
The Claik mostly uses session cookies that expire as soon as you close your internet browser. We only use persistent cookies to maintain the state of your questionnaire should you browse away from a survey and wish to continue where you left off. This cookie is in no way used for tracking or holding personal information and will be deleted at the end of the questionnaire or one day after the start of the questionnaire.
We also use a cookie to keep you logged in to The Claik website, to save you having to log in repeatedly.
Contact from The Claik
You will receive regular invitations to research studies as a member of The Claik.
Your participation in all questionnaires is voluntary and as such you may end your participation at any time.
You can unsubscribe from The Claik at any time by visiting insights.st-andrews.ac.uk and following the instructions.
As a member of The Claik you may request help from Largo with technical or research-related queries. Largo will only address such queries where a member has specifically requested help. Largo may ask the University of St Andrews or its service provider to reply to you on their behalf.
Conduct of Members
Registered members agree to take sole responsibility for their conduct when using The Claik website.
We will not tolerate:
Communication of material that is offensive, sexually explicit, immoral, dishonest, infringes on any third-party rights, or is of an illegal nature. We reserve the right to remove any posts that do not comply with the conduct expected of members.
Transmission in any form of a programme or file which is capable of interrupting, destroying, or limiting the capabilities of the website, server, connected networks, or other users’ computers.
Transmission of content for commercial reasons, including any advertising or promotional materials.
Attempts to register more than one account per person.
Termination
The University of St Andrews reserves the right to temporarily suspend or permanently disable a member’s account without prior notification or warning where the University of St Andrews finds that a member has been dishonest in completing the registration survey, has engaged in conduct noted above that the University of St Andrews confirms they will not tolerate, or has otherwise committed a breach of these Terms and Conditions.
The member will be informed by email of the termination of their account.
General
We shall not be liable for any delay or failure to provide our services or perform any obligation under these Terms and Conditions if the delay or failure is caused by circumstances beyond our reasonable control.
Nothing in these Terms and Conditions is intended to confer on any person any right to enforce any term of these Terms which that person would not have had but for the Contracts (Third Party Rights) (Scotland) Act 2017.
Each of the provisions of these Terms and Conditions (or part of any provision) is severable. If any such provision is or becomes illegal, invalid or unenforceable in any respect under the law of any jurisdiction that shall not affect the legality, validity or enforceability of the other provisions of these Terms and Conditions. The provision itself shall apply with the minimum modification necessary to make it legal, valid and enforceable.
Failure or delay by us in enforcing these Terms and Conditions shall not be a waiver of that or any other provision of these Terms and Conditions.
The University of St Andrews and Largo comply with the UK Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR).
These Terms and Conditions shall be governed by and construed in accordance with Scots law. Any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the Scottish courts.
